Terms of service

The service

TackoMod reads Twitch chat, applies the rules you write, and explains each decision. It starts in Watch. In Watch it does not remove messages. When you turn enforcement on, a line that clears the bar can be removed, and a repeat can be timed out. A ban is not an automatic action. Messages from the broadcaster or a moderator are not acted on.

On a live channel the check gives up after 2.5 seconds. If the model has not answered, the line stays up. Leaving a line up is the failure mode we chose. A late removal is worse than a miss.

TackoMod sits beside the bots you already use for commands, timers, and song requests. Those tools are not part of this service.

Who can use it

You need a Twitch account. You must be at least 13 years old. You must be at least 18, or the age of majority where you live, to buy a paid plan. A person under 13 must not use TackoMod.

You may connect a channel only if you control it, or the broadcaster has asked you to moderate it. You are responsible for following Twitch's terms and the law that applies to your channel.

Your rules

You write the rules in ordinary language. We apply the version that is published at the time of the decision, and the decision records which version that was. You are responsible for the rules you publish. A rule that asks us to break the law, or to break Twitch's rules, is one we will not carry out, and we may refuse it.

Viewers wrote the chat. You give us permission to process that chat so we can moderate the channel. You keep your channel. We do not take ownership of viewer messages.

What a decision is

A decision is our judgment of one line against your rules and the safety checks. It includes a reason. It can be wrong. You can undo a removal. You remain the moderator of your community. TackoMod does not replace your judgment, and it does not make you compliant with any law by itself.

The measurements we publish on the site are the results of the dated runs we show there. They are a record of those runs. They are not a promise that a future stream will match them.

Plans, caps, and payment

The plans, the monthly price, the scan cap, the history window, and the seats are:

• Watch: Free, 3,000 scans, 7-day history, 1 seat.
• Guard: $15 a month, 50,000 scans, 30-day history, 3 seats.
• Channel: $29 a month, 250,000 scans, 90-day history, 10 seats.
• Partner: $79 a month, 2,000,000 scans, 90-day history, unlimited seats.

Watch does not remove messages. Guard, Channel, and Partner can, after you turn enforcement on. Hitting a scan cap does not add a charge. For the rest of that month the model pauses, and checks that do not need the model can continue.

Paid plans are billed monthly through Stripe. We do not store your card number. Stripe does. Taxes, when they apply, are added by Stripe.

To cancel, email tackomod@gmail.com. We cancel the Stripe subscription, and the channel returns to Watch. A fee already paid for the current month is not refunded, except where the law requires a refund, or where we or Stripe charged you by mistake. If that happens, email us and we will correct it with Stripe.

Stopping and deleting

You may disconnect a channel at any time. Disconnecting revokes our Twitch token and stops chat delivery to us. The token is not restored. Connecting again is a new connection.

You may delete the account by emailing tackomod@gmail.com. We revoke the Twitch token when we start, and we erase the account 24 hours later. You may cancel that erasure during the 24 hours by emailing us. Canceling does not restore the Twitch token or the chat subscription. The privacy policy describes what erasure removes.

If you remove our access on Twitch, we disconnect the channel when Twitch tells us. Twitch's own terms still apply to your account there.

Acceptable use

You will not:

• moderate a channel you do not control and were not asked to moderate
• use the service to harass, threaten, or dox anyone
• use the service to break the law or Twitch's rules
• probe, scan, or overload the service, or send the public demo more than 30 lines a minute
• try to make the model ignore the rules or reveal tokens, keys, or other people's channels
• resell the service or hold it out as your own product

We may suspend a channel that breaks this section. We will email the address we have, when we have one, and say what happened. If the suspension was a mistake, email us and we will put the channel back.

The public demo

Lines you type into the demo, and the sample stream, are scored by the live model. The demo does not remove messages on a Twitch channel. Do not put a secret, a password, or someone else's private information into it.

Our software and your feedback

We own the TackoMod software, the name, and the mark. These terms do not give you the right to copy the software. When you tell us a decision was right or wrong, we may use that correction to fix the product. We do not take ownership of your rules or your channel.

Other services

Twitch and Stripe have their own terms. A failure or change on their side can stop a login, a removal, or a charge. We are not those companies.

Disclaimers

The service is provided as it is and as it is available. We do not promise that every attack will be caught, that no line you wanted will be removed, or that the service will be up every minute. To the extent the law allows, we disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Limits on liability

We are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost viewers, or lost goodwill. Our total liability for a claim arising out of the service is the greater of fifty U.S. dollars or the amount you paid us for the service in the three months before the claim.

These limits do not apply to liability the law does not allow us to limit, including fraud and willful misconduct. Some places do not allow certain limitations. In those places, the limits apply only as far as the law allows.

Your responsibility for a claim

If a third party brings a claim against us because of your rules, your channel, or your misuse of the service, you will cover the resulting damages and reasonable legal costs, except to the extent the claim was caused by our fraud or willful misconduct.

Ending the service

You may stop using TackoMod at any time by disconnecting and, if you want the account gone, by asking us to delete it. We may stop providing the service. If we shut it down, we will email the address we have from Twitch, when we have one, and we will erase accounts on the schedule in the privacy policy if you ask.

Changes to these terms

When we change these terms we change the date at the top. If the change is material and we have an email from Twitch for the account, we send it. Continuing to use the service after that date means you accept the updated terms. If you do not accept them, disconnect and email us to delete the account.

Law and disputes

These terms are governed by the laws of the United States, without regard to conflict-of-law rules. The courts that can hear a dispute are the state and federal courts that have authority over TackoMod. Email tackomod@gmail.com and we will tell you which court that is. We do not publish a street address on this site.

Before either of us files a claim, we will try to resolve it by email. Send a short description of the dispute and what you want. We will answer within 30 days.

The whole agreement

These terms and the privacy policy are the whole agreement about TackoMod. If a court holds one sentence unenforceable, the rest still stands. A failure to enforce a sentence once is not a waiver of it. You may not assign these terms. We may assign them to a successor that continues the service, and we will email you if we do.
